Preparing Your Professional Will/Directive Regarding the Disposition of a Clinical Practice: Ethical, Legal and Clinical Considerations

This workshop will consist of two related parts. The first will be a review of ethical, legal and clinical considerations involved in preparing a Professional Will. Material from the newly revised APA Record Keeping Guidelines (2007) will be included in this portion of the workshop. This will be followed by a brief discussion of collegial, familial and personal considerations in preparing a Professional Will. This, in turn will be followed by a brief discussion of considerations involved in selecting an individual (s) to serve as the Executor for a Professional Will. Guidelines for a Professional Executor will also be included in this part of the presentation. The first part will conclude with a review and discussion of two documents: Guidelines for Preparing a Professional Will and a format for a Professional Will.
In the second part of this workshop the participants will be asked to constitute a small working group. All participants will have a copy of the following three documents: Guidelines for Preparing a Professional Will, a Professional Will format and Guidelines for a
Professional Executor. The goal for the group will be to have each member complete a draft of their own Professional Will with Task Force members serving as consultants/resource persons. At the conclusion of the second part of the workshop, there will be time for concluding questions, discussion and closure.
